Έξι χρόνια χρειάστηκαν να περάσουν μέχρις ότου το Συμβούλιο της Επικρατείας να αποφασίσει ότι η λάσπη από το Κέντρο Επεξεργασίας Λυμάτων της Ψυττάλειας θα εξακολουθήσει να μεταφέρεται στο χώρο υγειονομικής ταφής απορριμμάτων των Άνω Λιοσίων.
Στο Ανώτατο Δικαστήριο είχε προσφύγει το 2004 η ΕΥΠΑΠ και ζητούσε την ακύρωση της απόφασης που είχε λάβει η εκτελεστική επιτροπή του Ενιαίου Συνδέσμου Δήμων και Κοινοτήτων , με την οποία είχε απαγορευτεί η διάθεση στο ΧΥΤΑ Α. Λιοσίων λάσπης από την Ψυττάλεια.
Είχαν προηγηθεί δύο αποφάσεις από το τμήμα αναστολών του ΣτΕ(2 Μαρτίου και 31 Μαΐου 2005) που είχε υποχρεώσει τη χωματερή Άνω Λιοσίων να δέχεται τα απόβλητα (λάσπη) από την Ψυτάλλεια μέχρι την έκδοση οριστικής απόφασης, η οποία εκδόθηκε τελικά ύστερα από έξι χρόνια.
